The Federal Ministry of Labor is planning a fundamental return to the home office offer obligation. Employers should again be obliged to offer employees to work from home to protect themselves from corona infections. However, there should be exceptions.
This emerges from the draft bill for a SARS-CoV-2 occupational safety regulation from the house of Labor Minister Hubertus Heil (SPD), which is available to the German Press Agency in Berlin. The news portal “The Pioneer” had previously reported. The regulation is to come into force on October 1st and apply until April 7th, 2023.
A home office offer obligation expired in March. According to the draft, the number of infections is now expected to increase again. Employers should be obliged to create a hygiene concept with proven protective measures.
This includes, among other things, a “reduction in company personal contacts, for example by reducing the simultaneous use of rooms and by offering employees the opportunity to work from home”.
